La Ley de 1 de marzo de 1940 sobre represión de la masonería y comunismo establecía en su artículo 12 la creación de un tribunal especial para el procesamiento de los sospechosos de ambos delitos. El tribunal se constituyó por un Decreto de Presidencia del Gobierno de 4 de junio de 1940, nombrándose primer presidente del mismo a Marcelino de Ulibarri Eguilaz. Éste era miembro de Comunión Tradicionalista Carlista y había sido nombrado anteriormente Delegado del Estado para la Recuperación de Documentos (Orden del Ministerio del Interior de 7 de mayo de 1938). Posteriormente, por otro Decreto de 31 de marzo de 1941 se reorganizó el tribunal, siendo nombrado presidente el general Andrés Saliquet Zumeta. Marcelino de Ulibarri abandonó la presidencia y fue designado Vocal Ponente y Delegado del Tribunal Especial para la Represión de la Masonería y el Comunismo, conservando al mismo tiempo el puesto de jefe de la Delegación del Estado para la Recuperación de Documentos. Finalmente, en agosto de 1942 Ulibarri presentó su dimisión de ambos cargos. El puesto de Vocal Ponente y Delegado del TERMC permaneció vinculado a la presidencia de la Delegación Nacional de Servicios Documentales hasta la supresión del propio TERMC en virtud de la Ley 154/1963, de 2 de diciembre (BOE de 5 de diciembre), que entró en vigor el 3 de febrero de 1964.
Article 12 of the Law of 1 March 1940 for the repression of Freemasonry and Communism laid down the establishment of a special court for the prosecution of crime suspects. The court was set up by Decree of Presidency of the Government issued on the 4th June 1940, and Marcelino de Ulibarri Eguilaz was appointed president. He was a member of the Carlist Traditionalist Communion, formerly appointed Delegate of the State for the Recovery of Documents (Order by the Ministry of the Interior issued on the 7th May, 1938). By the subsequent Decree of 31 March 1941, the court was reorganized and chaired by the general Andrés Saliquent Zumeta. Marcleino de Ulibarri ceased to be president and was appointed Spokesperson and Delegate of the Special Court for the Repression of Freemasonry and Communism, preserving his position as the leader of the State Delegation for the Recovery of Documents. In August 1942, Ulibarri requested his removal from office. The link between the position of the Spokesperson and Delegate of the Special Court for the Repression of Freemasonry and Communism and the presidency of the National Delegation for Documentary Services remained until the abolition of the court by virtue of the Law 154/1963 issued on the 2nd December (Official State Gazette of the 5th December) and enacted on the 3rd February, 1964.
